Understanding Different Types of Green Cards and Their Eligibility Requirements

Green cards are essential for immigrants seeking permanent residency in the United States. They allow individuals to live and work in the country indefinitely. This guide explains the different types of green cards and their eligibility criteria.

Family-Based Green Cards

Family-based green cards are for individuals with close family members who are U.S. citizens or permanent residents. There are two main categories:

  • Immediate Relatives: Spouses, children (under 21), and parents of U.S. citizens.
  • Family Preference: Includes adult children and siblings of U.S. citizens, as well as spouses and children of permanent residents.

Employment-Based Green Cards

Employment-based green cards are granted based on job skills and employment opportunities. The five preference categories are:

  • EB-1: Priority workers, including multinational executives, outstanding professors, and individuals with extraordinary abilities.
  • EB-2: Professionals with advanced degrees or exceptional abilities.
  • EB-3: Skilled workers, professionals, and other workers.
  • EB-4: Special immigrants, including religious workers and certain international organization employees.
  • EB-5: Investors who invest $1 million (or $500,000 in targeted employment areas) in a new commercial enterprise that creates at least 10 full-time jobs.

Diversity Lottery Green Cards

The Diversity Visa Lottery, known as the green card lottery, awards up to 50,000 visas annually to individuals from countries with low immigration rates to the U.S. Eligibility requirements include:

  • Being from an eligible country.
  • Having at least a high school education or equivalent, or two years of work experience in the past five years in an occupation requiring at least two years of training.

Humanitarian Green Cards

These are granted to individuals needing protection or assistance. Categories include:

  • Asylum: For those who have suffered persecution or fear persecution due to race, religion, nationality, membership in a particular social group, or political opinion.
  • Refugees: Similar to asylum seekers but apply for refugee status while outside the U.S.
  • T Visas: For victims of human trafficking.
  • U Visas: For victims of certain crimes who have suffered substantial mental or physical abuse and are helpful to law enforcement or government officials in the investigation or prosecution of criminal activity.

Special Immigrant Green Cards

Special immigrant categories include various specific groups, such as:

  • Religious workers.
  • Juveniles needing protection due to abuse, abandonment, or neglect.
  • Afghan and Iraqi translators or interpreters who have worked with the U.S. Armed Forces.
  • Employees of international organizations and NATO.
